VITO TECHNOLOGY CONTEST: RULES and CONDITIONS

Star Walk® Month of Astronomy

PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) OF THIS CONTEST (“CONTEST”) CAREFULLY BEFORE SUBMITTING YOUR ANSWERS TO QUIZ QUESTIONS  (“CONTEST QUESTIONS”) POSTED BY VITO TECHNOLOGY, INC. (“VITO”).  IF YOU DO NOT WISH TO ACCEPT THIS TERMS, YOU WILL NOT BE ABLE TO PARTICIPATE IN THE CONTEST.  BY PARTICIPATING IN THE CONTEST, YOU ACCEPT FULLY AND UNCONDITIONALLY THESE TERMS AND THE DECISIONS OF VITO, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE CONTEST. WINNING ANY PRIZE IS CONTINGENT UPON FULFILLING ALL REQUIREMENTS SET FORTH HEREIN.

1. Requirements and Conditions for Contest.

To enter the Contest you need to:

A. Share the link to this Contest on any of your social profiles (i.e. Twitter™, Facebook™, Google+™);

B. Give at least one correct answer to the Contest Questions posted during the Star Walk Month of Astronomy on official profiles of Star Walk® on Twitter and/or Facebook. (Search for #starwalk); and

C. “Like” Star Walk® page on Facebook or follow Star Walk® @StarWalk on Twitter.

The Contest is held between [00:00 (EST time) July 17th, 2012 until 23:59 EST August 13th, 2012].  You will find the Contest Questions on official profiles of Star Walk® on Twitter (http://twitter.com/StarWalk) and Facebook (http://www.facebook.com/StarWalkApp). You may also be required to submit additional information in event that you win the prize as per Section 3 below.  All information that you provide to Vito under this Terms is subject to Vito’s Privacy Policy.  If you provide false and/or unverifiable contact or other information you will be denied the right to participate in the Contest and to receive the prize.  

By providing answers to the Contest Questions you agree to the following:

1. You are at least eighteen (18) years of age fully comply with the terms and conditions of Section 3 below.
2. You shall be solely responsible for your own answers to the Contest Questions and the consequences of posting or publishing them.  
3. Vito expressly disclaims any and all liability in connection with the Contest.
4. Apple does not endorse and is not affiliated with this Contest.
5. Decisions on all matters relating to the conduct of the Contest, as well as the results of the Contest are final and are at sole discretion of Vito.

Any individuals (including but not limited to employees, consultants, independent contractors, and interns) who have, within the past six months, performed services for Vito or any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Contest or supplying the prize, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter the Contest. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses. “Household members” shall mean people who share the same residence at least three months in one calendar year.

1. How the Winner Will be Determined.

Each time you answer a Contest Question correctly your name will be entered for the weekly lucky pick for the prize. The more correct answers you post, the more chances you have to win one of our prizes.  Each entrant into the Contest can win maximum of one prize. No purchase is necessary to enter or win the prize.

1. Prize

One winner of the Contest will be selected each calendar week, so overall four (4) winners will be selected during the duration of the Contest.  As a reward Vito will present each of the four winners with prizes as follows:

1st week (17-22th of July)

1. Prize one $10 iTunes card and five t-Shirts

2nd week (23d-29th of July)

1. Prize one $15 iTunes card and five t-Shirts

3rd week (30th of July - 5th of August)

1. Prize one $25 iTunes card and five t-Shirts

4th week (6-12th of August)

1. Prize one $50 iTunes card and five t-Shirts

Finalize the results on 12th of August

1. MAIN PRIZE: the new iPad estimated value of US $499

The Prizes will be shipped to the winners within 2 months of the Contest’s closing date. The prize is non-transferable. There may be no cash or other substitutions of prizes by the winner, however, Vito reserves the right to substitute similar prizes of equal or greater value in the event the above prize is unavailable for any reason.  Individual, parent or legal guardian of winner is solely responsible for all applicable federal, state and local taxes with respect to entire prize.

Winner or parent or legal guardian of the winner must sign an affidavit that: (a) releases, indemnifies and holds harmless Vito, its parent, affiliated, subsidiary and successor companies, and its respective officers, directors, employees, agents, and representatives, advertising agencies and promotional sponsors (collectively the “Release”) from and against any and all harm, expense, liability or injury that may be sustained relating to or arising from participation in the Contest or acceptance or use of the prize; and (b) authorizes the Releasee to use the winners’ names, likenesses, photographs, voices and biographical data for any purpose, in any media, unless prohibited by law.

Prize will not be released until Vito receives all required documents. Failure of the winner to return the forms within the required timeframe will result in automatic forfeiture of any prizes and all such prizes shall be awarded to an alternate winner. In the event of a prize forfeiture, the winner or parent or legal guardian of the winner forfeiting prize will sign a Prize Forfeit Form and return to Vito within ten (10) days of receiving the Form.

Vito reserves the right to change this Contest at its sole discretion at any time that Vito become aware of any circumstances or occurrence that would materially affect the Contest’s security or fairness. Vito reserves the right to announce any Contest’s rules changes in print or electronically. Vito is not responsible for the inability of the winner to accept the prize for any reason.

1. LIMITATION ON LIABILITY 

Winner, by accepting the prize, agrees to release Vito from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of any prize or while traveling to and from a location to obtain or use any prize. Vito make any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the use of any prize including, without limitation, quality, merchantability, or fitness for a particular purpose. Vito is not responsible for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by you or any third party, the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest and which may limit a participant’s ability to participate in this Contest.  The Contest shall be governed by, construed and enforced in accordance with the laws of the Commonwealth of Virginia, USA.  In the event of a dispute concerning who submitted an e-mail entry, the entry will be declared to have been made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
